AB 1482 California Tenant Protection Act

California's statewide rent cap limits annual rent increases on covered units to 5% + CPI (capped at 10%) and imposes "just cause" eviction requirements after 12 months of tenancy. The interplay between AB 1482's exemptions (single-family homes owned by individuals, properties less than 15 years old, and certain owner-occupied units) and its mandatory disclosure requirement is the single most common compliance failure across San Bernardino County's diverse rental market.

Code of Civil Procedure §1161 Unlawful Detainer

California eviction starts with a 3-day notice (pay or quit, cure or quit, or unconditional quit) or a 30/60-day no-cause notice for tenancies of less than or more than one year. The unlawful detainer is filed in Superior Court, summons served, and trial set within 20 days of an answer. Procedural defects in the notice are the leading reason San Bernardino County evictions are dismissed.

Civil Code §2924 Non-Judicial Foreclosure

Most California foreclosures proceed without court involvement. The trustee records a Notice of Default, waits at least 90 days, then records a Notice of Trustee's Sale before the auction. Civil Code §1102 Transfer Disclosure Statement (TDS)

California sellers must deliver a TDS disclosing all material facts about the property's condition. Failure to disclose known defects — water intrusion, foundation issues, unpermitted work, settlement, mountain road access disputes — is a frequent source of post-closing litigation in San Bernardino County.
